Terms of Service & User Agreement

Last Updated: October 2026 • Governing Jurisdiction: Republic of India

1. Acceptance of Terms

By accessing or registering on MyScoop (myscoop.in, its creator storefronts, APIs, automated bots, or payment checkouts), you (“User”, “Creator”, or “Buyer”) agree to be legally bound by these Terms of Service, our Privacy Policy, Refund Policy, and Cookie Policy.

2. Nature of Platform & Safe Harbor Intermediary Status

MyScoop is an internet-based technology service provider operating as an Intermediary under Section 2(1)(w) and Section 79 of the Information Technology Act, 2000 (IT Act, 2000), read with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

  • MyScoop provides technological infrastructure, edge routing, automated bot invitations, and payment reconciliation tools for independent creators, educators, and service providers.
  • MyScoop does not initiate the transmission, select the receiver of the transmission, or modify the information contained in the transmission.
  • All sales transactions represent direct contracts between the independent Creator and the Buyer. MyScoop is not an employer, retail vendor, publisher, or distributor of Creator content.

3. Prohibited Content & SEBI Compliance Rules

Creators strictly agree that they shall NOT offer, sell, or promote:

Strictly Prohibited Marketplace Categories:
  • Unregistered Financial & Stock Advisory: Any stock tips, options/futures recommendations, algorithm leasing, or trading signals offered without valid registration with the Securities and Exchange Board of India (SEBI) under SEBI (Investment Advisers) Regulations, 2013 or SEBI (Research Analysts) Regulations, 2014.
  • Adult / Sexually Explicit Content: Pornography, escort services, or explicit adult files.
  • Infringing / Stolen Assets: Pirated course rips, unauthorized software cracks, leaked databases, or stolen vector packs.
  • Gambling & Speculative Schemes: Betting tips, casino bots, multi-level marketing (MLM), or guaranteed return schemes.
  • Malware & Exploit Kits: Keyloggers, phishing scripts, or ransomware software.

Violation of these rules results in immediate account blocking, forfeiture of unpaid platform balances, and referral to appropriate law enforcement authorities under Section 67 and 69A of the IT Act.

4. Payments, Platform Tiers, Bank Settlements & AutoPay Architecture

  • Payment Aggregator Rails: All payment collections, UPI intents, and dynamic QR checkouts operate via RBI-authorized payment aggregators (Razorpay Software Pvt. Ltd. / Cashfree Payments India Pvt. Ltd.). MyScoop does not hold customer funds directly and does not operate as a prepaid payment wallet.
  • Platform Commission Tiers: Platform transaction commissions are determined dynamically by the creator's active subscription tier:
    • Digital Storefront (₹0/mo): Flat 10% platform fee on completed digital sales (you keep 90%). Every creator starts with 1 GB storage, automatically scaling up to 10 GB as sales milestones are reached.
    • Video Academy & Courses (₹999/mo): Flat 10% platform fee on course sales + ₹999/mo for 30 GB high-speed private cloud video hosting (~25–30 hours) with 100% free streaming bandwidth. Dedicated admin onboarding required prior to course publication.
Standard payment gateway processing pass-through (~2.0% + 18% GST on processing fee = ~2.36%) applies to all customer transactions and is deducted at settlement.
  • Direct Bank Settlement Narration (“MYSCOOP - ADITYA”): Net creator payouts settle directly into the Creator's verified Indian bank account via IMPS/NEFT rails under Razorpay Route. Under RBI and NPCI standards, bank statements display:
    Passbook Descriptor: CMS/MYSCOOP-ADITYA/{UTR}/SETTLEMENT
    Statement Narration: MYSCOOP - ADITYA
Settlement schedules strictly operate under standardized weekly institutional rules:
    • Weekly Wednesday Only: Payouts process strictly on Wednesdays only for all cleared transactions accumulated up to Tuesday 23:59 IST.
    • Mandatory ₹500 Minimum Threshold: Net earnings below ₹500.00 are not disbursed and roll over automatically to the following Wednesday until ₹500 is reached.
    • KYC Verification Lock: Permanent Account Number (PAN) and penny-drop bank account name verification are mandatory prior to the release of any initial payout.
    • T+3 Rolling Reserve for New Stores: New creator storefronts operate on a 3-day (T+3) rolling reserve hold on settled transactions during their initial 30 days of platform activity to deter fraudulent behavior.
    • Dispute & Chargeback Retention: Flagged orders, consumer chargebacks, or active intellectual property complaints freeze corresponding funds inside creator pending ledgers until formal resolution.
  • Dual Subscriptions Architecture:
    • Platform SaaS Subscriptions: Creators subscribing to the optional Video Academy hosting plan (₹999/mo, or ₹9,990/yr) — or to self-serve Native Storage Boosters (₹199–₹1,499/mo) — authorize a recurring UPI AutoPay mandate. If a renewal fails, a 72-hour grace period applies with 3 automated retries. If unpaid or cancelled, the account safely reverts to Free Digital Store (10% fee) with zero deletion of creator storefronts, products, custom links, or customer data.
    • Creator Community & Service Subscriptions: End-user customers subscribing to a creator's VIP Telegram channel or monthly retainer authorize a recurring mandate under RBI circular DPSS.CO.PD.No.447/02.14.003/2021-22. Pre-debit notifications are dispatched 24 hours prior to debit. Mandates can be revoked anytime via the subscriber's UPI application.
  • Automated Telegram Bot Community Enforcement: Community channel access is managed by our official bot (@My_Scoop_Bot). Upon payment, the bot issues a secure single-use invite link (member_limit=1). If a subscriber cancels their AutoPay or a renewal fails past the 48-hour grace window, the bot automatically removes (kicks) the member from the private channel.
  • Tax Withholding (Section 194-O of the Income-tax Act, 1961 TDS & GST TCS): MyScoop operates as an e-commerce operator under Section 194-O of the Income-tax Act, 1961 and withholds TDS on gross creator sales at 0.1% when the creator furnishes a valid Permanent Account Number (PAN) or Aadhaar number. Creators must furnish PAN during onboarding; where none is furnished, the statutory penalty rate of 5% applies. Individual and HUF creators remain exempt from this withholding while their annual gross sales on the platform stay within the statutory threshold of ₹5,00,000. Tax Collected at Source (TCS) under Section 52 of the Central Goods and Services Tax Act, 2017 is reported via GSTR-8. Statutory withholding obligations are computed and reported by MyScoop; payment gateway partners do not discharge them on MyScoop's behalf.

5. Copyright Infringement & DMCA Takedown Procedure

In compliance with the Copyright Act, 1957 and Rule 3(1)(d) of the IT Rules 2021, MyScoop enforces a formal notice-and-takedown mechanism. If you believe your copyrighted work is being infringed on a creator's storefront:

  1. Submit a written notice to our designated Grievance Officer at support@myscoop.in.
  2. Include evidence of your copyright ownership, URL of the infringing asset, and a declaration of good faith under penalty of perjury.
  3. Upon receipt of a valid statutory notice or court order, MyScoop will disable access to the infringing material within 36 hours.

6. Creator / Seller Addendum

This section applies only to Creators — accounts that list, sell, or offer products or services on MyScoop. Every signed-in user accepts the platform terms above; a Creator separately accepts this Addendum before managing a storefront, because selling makes you the seller of record. Buyers who never sell are not bound by it.

  • Seller of Record: You, the Creator, are the seller of record for every listing on your storefront. Each sale is a direct contract between you and the Buyer. MyScoop is an intermediary and technology provider — not the seller, publisher, or distributor of your content.
  • Indemnity: You agree to indemnify and hold harmless MyScoopagainst claims, losses, liabilities, and expenses arising from your listings, your content, your conduct, or your breach of this Addendum — including buyer disputes, IP claims, and regulatory actions tied to what you sell.
  • Prohibited Categories & Compliance: You must not list anything in the prohibited categories in Section 3 (unregistered financial advice, adult content, infringing assets, gambling/MLM, malware). Where your listings touch regulated activity (e.g. investment advice), you warrant you hold the required SEBI or other registrations.
  • Tax Obligations (TDS/TCS): As an e-commerce participant you must furnish a valid PAN (or Aadhaar) for statutory TDS/TCS reporting under Section 194-O of the Income-tax Act, 1961 and Section 52 of the CGST Act, 2017. See Section 4 for withholding mechanics.
  • KYC Before Payout: PAN and penny-drop bank verification are mandatory before any payout is released.
  • Refunds Are Seller-Funded: Refunds issued to Buyers are funded from your pending/future earnings — not from MyScoop's own funds. See the Refund Policy.
  • Age & Capacity: You warrant you are 18 years of age or older and legally competent to enter this Addendum.
  • Storage & Inactivity: Every creator receives 1 GB free cloud storage, expanding to 3 GB, 5 GB, and 10 GB based on verified sales volume. Accounts with zero logins and zero sales for 45 days receive warning notices; accounts inactive for a further 14-day grace period are permanently deleted along with hosted media.
  • Termination: Breach of this Addendum — including listing prohibited content or fraudulent conduct — results in immediate blocking, forfeiture of unpaid balances tied to disputed or fraudulent orders, and referral to law enforcement.

7. Governing Law & Dispute Jurisdiction

These Terms shall be interpreted, construed, and governed solely by the laws of the Republic of India. Any legal dispute, arbitration, or proceeding shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka, India.
